General Terms and Conditions (GTC) of Edeltropfen GmbH

General / Scope of application

The general terms and conditions (AGB) form the basis of the customer relationship. By placing an order, the customer agrees to the general terms and conditions. It is important to us to serve our customers to their full satisfaction. These General Terms and Conditions (GTC) apply to all orders placed by customers residing in Switzerland or the Principality of Liechtenstein via the online shop of Edeltropfen GmbH, Einsiedlerstrasse 6, 8820 Wädenswil, www.edeltropfen.ch, info@edeltropfen.ch, hereinafter referred to as edeltropfen.ch. Deviating agreements must be in writing to be valid.

Our offer is directed to Switzerland and the Principality of Liechtenstein; edeltropfen.ch does not deliver abroad. The law prohibits the sale of spirits, aperitifs and alcopops to under 18-year-olds and of wine, beer and cider to under 16-year-olds. In order to comply with the legal requirements, especially in the online wine shop, we require you to state your date of birth.

Prices / Availability

Our prices are quoted in Swiss francs (CHF), plus the statutory value added tax and shipping costs for dealers; for private customers, value added tax is included and only the shipping costs are added to the stated purchase price. In the case of collection by dealers or private customers, the shipping costs are not applicable. In principle, the products we offer online are available from stock. Edeltropfen.ch is entitled to cancel orders at any time and without giving reasons and/or to provide only partial. In the case of a partial or complete cancellation of the order, the customer pays only the partial performance effectively rendered by edeltropfen.ch. Edeltropfen.ch is in no case obliged to procure products or certain vintages of wines.

Terms of payment

Orders are always placed against prepayment, by credit card, Twint or Paypal. Edeltropfen.ch is free in the choice of new or deselection of existing payment options.

Payment against invoice is only possible in exceptional cases and must be agreed with edeltropfen.ch in advance. In this case the purchase price is due within 8 days after delivery of the goods. If the payment does not take place within this period, the customer is in default. In case of default of payment we charge default interest and reminder fees. If the outstanding amount is not paid even after the last reminder, edeltropfen.ch initiates the collection.

The goods remain the property of Edeltropfen GmbH until full payment has been received. Edeltropfen GmbH is entitled at any time to register the reservation of title with the competent authority.

Deliveries

There is no minimum amount for online orders. Each item can be ordered separately. Edeltropfen.ch is entitled to carry out deliveries in several parts. Such partial deliveries do not result in additional costs for the customer.

Basically, all products offered by us are available from stock. In individual cases it can occur that an article is briefly sold out or no longer available. In this case you will be notified by email. All dispatch and delivery dates communicated by edeltropfen.ch serve exclusively the orientation of the customer and are not legally binding. The customer is not entitled to any rights against edeltropfen.ch from the exceeding of dispatch and delivery dates.

If a successful delivery is not possible or only possible under difficult circumstances for reasons for which edeltropfen.ch is not responsible - e.g. a wrong delivery address, absence of the recipient, missing access permit or other - the customer is obliged to place edeltropfen.ch financially as if the delivery had been successful.

There will be no shipment abroad.

Inspection by the customer

The customer checks the delivery received from edeltropfen.ch within 5 calendar days after delivery and notifies edeltropfen.ch of any defects or incomplete deliveries in writing, i.e. by letter or e-mail.

Damaged articles can be exchanged. However, the customer must pay for the return transport himself.

Edeltropfen.ch assumes liability only for intentional or grossly negligent direct damages in connection with the performance of the contract. Any further liability or obligation is hereby excluded. This also applies to consequential damages.

Due to missing goods or wrong delivery no claims for damages can be asserted against edeltropfen.ch.

Use and risk

Use and risk of the services to be rendered by edeltropfen.ch are transferred to the customer when leaving the services at the registered office of edeltropfen.ch.

Place of performance

Place of performance for all obligations is the registered office of edeltropfen.ch.

Severability clause

Should any provision of these GTC be or become invalid or void, this shall invalidate the validity of the remaining provisions.

Applicable law and place of jurisdiction

Our business activities are based exclusively on Swiss law. Place of jurisdiction is Zurich.
